Sample Language for Wills and Trusts

If you wish to make a bequest to the national office, we suggest you use the following language:

Outright Bequest

I give, devise, and bequeath to the Epilepsy Foundation (National Office), a national 501(c)(3) tax-exempt organization, headquartered at 8301 Professional Place, Landover, Maryland 20785-7223, the sum of $ _____ (or real or personal property herein described), to be used for the general purposes of the Foundation at the discretion of its Board of Directors.

Residuary Clause

All the rest, residue, and remainder of my estate, both real and personal, I give, devise and bequeath to the Epilepsy Foundation (National Office), a national 501(c)(3) tax-exempt organization, headquartered at 8301 Professional Place, Landover, Maryland 20785-7223, to be used (a) to advance the general purposes of the Foundation as its Board of Directors may determine; or (b) for __________________ (a specified purpose).

Bequest for a Specific Purpose

I give, devise, and bequeath to the Epilepsy Foundation (National Office), a national 501(c)(3) tax-exempt organization, headquartered at 8301 Professional Place, Landover, Maryland 20785-7223, the sum of $ _____ (or real or personal property herein described), for _________ (a specified purpose).

It is my preference that the gift remains used for the specified purpose. However, I understand and agree that if, at some future time, it is no longer practicable in the judgement of the Foundation Board of Directors to use the gift for the purpose intended, the Directors shall have the right to use the gift for whatever purpose they deem necessary and reasonable in accord with the intent described herein.

General Memorial Fund

I give, devise, and bequeath to the Epilepsy Foundation (National Office), a national 501(c)(3) tax-exempt organization, headquartered at 8301 Professional Place, Landover, Maryland 20785-7223, the sum of $ _____ (or real or personal property herein described), to be known as the __________ Memorial Fund. The Board of Directors of the Epilepsy Foundation (National Office), at its discretion, shall determine the use of the income from this fund for any purpose of the Foundation. The said Board of Directors may authorize the expenditure of all or any part of the principal of the fund for some project or special purpose that will forward their work of assisting Americans who are victims of epilepsy.

A gift designated "to support research" is sent to the national office.

If your client wishes to support a local affiliate, we suggest you make the gift to the national office and indicate that the donation or a portion of the gift be distributed to a local affiliate if one exists in the testator's community at the time of death. For example:

" . . . to be used to support the local Epilepsy Foundation affiliate in (location) if such an affiliate exists at the time of my death."
